| 10.12.2008 European Court of Human Rights European Court of Human Rights Judgment December 4, 2008 The blanket and indiscriminate nature of the powers of retention of fingerprints, cellular samples and DNA profiles of persons suspected but not convicted of offences failed to strike a fair balance between the competing public and private interests. Accordingly, the European Court of Human Rights held, unanimously, that as the retention in question constituted a disproportionate interference with the applicants' right to respect for private life and could not be regarded as necessary in a democratic society, there had been a violation of article 8 of the European Convention on Human Rights. | 17.11.2008 Virtual Courts Planned For London and Kent in 2009 The Virtual Court is a new initiative that will see the use of video conferencing between police stations and magistrates' courts to facilitate first court appearances for defendants. The project aims to speed up justice and thereby improve services to victims and witnesses. The concept was prototyped during 2007 in two London boroughs and following an evaluation it was decided that a full pilot should take place involving the Metropolitan Police in nine London boroughs and Kent Constabulary. Not only will the pilot involve the greater use of conferencing technology, which is already familiar within the CJS, but also the development of a "collaboration space" where electronic case files will be shared between the police, CPS and the court. The pilot aims to see defendant appear in the virtual court within hours of being charged rather than the current practice of bailing defendants to appear in several days or even weeks.
